Elias Robot application and service is developed and maintained by Curious Technologies Ltd, Company ID in Finnish Trade Register: 2863158-4, address: Siltavuorenpenger 7, 00170 Helsinki, Finland. These Terms & Conditions set out the rules for using the Elias Robot web application, Elias robot installation package for humanoid robots Nao V5, Nao6 and Pepper (by Softbank Robotics), as well as the Elias Robot website.

 

Curious Technologies Ltd (hereinafter “Elias Robot”, ”us”, ”we”, or ”our”) administers and offers for use the Elias Robot website, Elias Robot installation package for humanoid robots and the Elias Robot web application. By “Application”, we are referring to the Elias Robot Web Application, the Elias Robot Website and the Elias Robot installation package for humanoid robots Nao V5, Nao6 and Pepper (by Softbank Robotics). Reference to “Terms” shall mean these Terms & Conditions.

 

Accessing the Application from your mobile device, your computer or other hardware (“Device”) and/or at any time clicking “I AGREE” or such other button, link or click-through, constitutes your agreement to these Terms and to our Privacy Policy, which collectively form a legally binding agreement between you and Elias Robot (the “Agreement”). Your right to use the Application is conditioned upon compliance with these Terms and our Privacy Policy. We urge you to read these Terms and our Privacy Policy carefully before accessing the Application. If you do not agree to the terms of this Agreement, you may not download the Application or access or use the Application.    

 

Introduction

Elias Robot is designed for learning languages and communication skills.

  

The Application is an evolving one. The Application is continuously being updated and this may cause service breaks, disruptions or other similar issues. Where possible, you will be informed of all upcoming service breaks.

Disclaimer of warranty and liability

 

Unexpected and serious problems, and / or serious issues that prevent the implementation of Elias Robot application, will be resolved during the subscription term.

Neither Elias Robot, nor any of its respective employees, contractors, third party content providers or licensors warrant that use of the Application will be uninterrupted or error free; nor do they make any warranty as to (i) the results that may be obtained from use of the Application, or (ii) the accuracy, reliability or content of any information, service or product provided through the Application.

 

The Application is made accessible on an “as is” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Application will be suitable for all your needs. Elias Robot acts exclusively as a provider of the platform and users shall be liable for the use of the Application and the material and content they submit to the Application.

 

We will not be liable for any network-related problems attributable to the operation of the Application. Network configuration changes may affect the system’s performance.

 

The warranty does not apply to any hardware or software product that is not manufactured or developed by us. This restriction also applies to hardware and software sold or offered with Elias Robot. NAO and Pepper humanoid robots are warranted by Softbank Robotics Europe.

This section does not limit our statutory liability for defects in the Application in relation to our consumer customers or any liability that, by law, cannot be limited or restricted, or your statutory remedies for defects or delays under any applicable mandatory consumer protection laws.

Users’ obligations

​

Please note that as a user of the Application, you are responsible for your use of the Application and for the security of your Devices. You agree that you are personally responsible for the use of your account, and for all communication and activity in connection with the Application resulting from the use of your account. You are also responsible for ensuring the security of your licence key. You may not reveal, share or otherwise allow others to use your licence key, or use licence keys of others.

 

You must keep your licence key safe.

 

You are responsible for your use of the Application and for all information you submit to the Application.

 

You shall be liable for all your own Devices, internet connectivity and software and any costs thereof. You agree to not attempt to damage, hack, crack, reverse engineer, or otherwise interfere with the Application in any manner.

 

Storing and processing of user data

Information on the storing and processing of personal data is found in the Privacy Policy.

 

Modifications

​

We reserve the right to change, modify, add or remove parts of the Terms and the Privacy Policy at any given time by posting the amended Terms in the Application, and in case of substantial changes, by notifying users by email to the email address provided by the user when signing up to the Application. You will be deemed to have accepted such changes by continuing to use the Application. If you do not agree to the amendments, Elias Robot Privacy Policy, or any other rules relating to the use of the Application, you must immediately stop using the Application.

 

Restrictions of use

We may limit, suspend, terminate, modify, or delete accounts or access to the Application or parts thereof if you fail to comply, or if we suspect such failure, with the Terms or for any actual or suspected illegal or improper use of the Application, without notice to you. You may lose, as a result of termination or limitation of your right to use the Application, any additional content or other material associated with your use of the Application, and we are under no obligation whatsoever to compensate you for any such losses or results thereof.

 

We may change the pricing plan at our discretion. In case we make changes to the pricing, we will inform you before any such changes occur so you can modify or cancel your subscription before the changes become effective. We accept no responsibility for any losses you may incur if you decide not to continue your subscription after changes to the pricing.

 

The Application may contain links to websites operated by third parties or feature content which is made available in third-party services and which enable you to access and use certain third-party services. We assume no responsibility for such third-party services and/or content in third-party services.

 

Intellectual Property

The Associated content application (including the related software and media), the design of the Application and including text, scripts, graphics, interactive features and the like, and the trademarks, service marks and logos contained therein (“Elias Robot Property”) are owned by or licensed to Elias Robot and are subject to copyright and other intellectual property rights under Finnish and foreign laws and international conventions. Except as expressly provided in these Terms, Elias Robot does not grant any express or implied rights to use Elias Robot Property. You have no right to make available to third parties any content originating from the Application.

 

Users shall not upload, post or otherwise make available (or submit to Application for uploading, posting or to be made available) on the Application any material protected by copyright, trademark or other proprietary rights without the express permission of the owner of such proprietary right. Users shall be solely liable for any damage resulting from any infringement of intellectual property rights or any other harm resulting from such a submission.

 

Elias Robot does not monitor or review the content posted to the Application by users. Users shall be liable to ensure that they are entitled to submit the information to the Application. Users shall not submit to the Application any material that is unlawful or otherwise inappropriate.

 

Elias Robot shall have the right, but not the obligation, to monitor the content in the Application at all times, to determine compliance with these Terms and any operating rules established by Elias Robot, as well as to satisfy any applicable law, regulation or authorized government request.

 

Termination

Notwithstanding anything to the contrary herein, Elias Robot shall have the right, exercisable at its absolute and sole discretion, immediately to terminate this Agreement and your Elias Robot subscription and block your access to the Elias Robot Service at any time if you use the Application against these Terms or otherwise in a way which may harm Elias Robot or other users of the Application.

 

You may immediately terminate this Agreement at any time by discontinuing the use of the Application and terminating your Elias Robot subscription.

Governing Law and Jurisdiction

​

These Terms of Service will be governed by the laws of Finland, excluding its conflicts-of-law provisions.

 

Any disputes arising out of this Agreement will be referred to Helsingin käräjäoikeus (Helsinki District Court) as the court of first instance. Consumers are entitled to bring action in the court of first instance of their domicile. In case of disputes, consumers may also resort to the Consumer Complaints Board (kuluttajariita.fi) or the Online Dispute Resolution service provided by the European Commission (ec.europa.eu/odr).
